Premium Processed filings

All of our Premium Processed master cap H-1 B filings have been receipted by USCIS.

Premium Processed (regular cap) filing receipts started coming through on Monday (today).  We have notified individuals for whom we have received a receipt.  For those of you who have not yet received notification of receipt for your filing, USCIS has cautioned that it could take until 4/28 for them to receipt and start all Premium Processing cases and it is possible that they will stage cases to ensure they can meet the Premium Processing 15 day guarantee.  Please know that we will continue to pay close attention to our emails and notify individuals as new receipts come in.

For those cases receipted via Premium Processing the clock starts when the case is “received” which is either on or before the day we are notified.  So any case we’ve received notification on will be adjudicated before the end of April.

Regular H-1 case filings

For regular H-1 case filings, which is the bulk of H-1 filings (both from our office and others), we have yet to have any news.  This is not unlike last year when we first started to confirm receipt on 4/18 for regular case filings.

We will continue to monitor our bank account (for check cashing activity) and mail box and update each client individually on the day in which we have news.

Questions about Premium Processing

For those individuals who questioned us about upgrading to Premium Processing, this is not an option for any case already filed until USCIS has issued a receipt notice.  So we will wait until we have a receipt before taking any action on such requests.

Given the volume of applications received (roughly 172,500 as reported by USCIS) we understand that there is some anxiety about whether a particular case will be accepted or not.  We don’t want to speculate on anyone’s chances and will be sure to communicate with our clients directly when we have information.  Based on what we’ve seen so far, we expect that we’ll have a good sense of case outcomes (whether lottery selected or not) by the end of day on May 9th.  We want to thank all of our clients for continued patience with this process.
