This is simply a general reminder to all firm clients that the H-1 window will be opening again this coming April.  It’s time to start thinking about those individuals who may benefit or need H-1B status to continue their employment.  At the same time, given that we again expect significant pressure on the H-1B quota numbers, and that only 50% of those filed will be accepted into processing, it is also important to start considering fall back positions should the application not be accepted through the lottery.  Internally we are tracking all 2016 H-1B applications we have been advised of, should you hire anyone else who you think requires an H-1B petition, please let us know.  Please also know that the cost of filing H-1B petitions for employers with at least 50% of their employees in an H or L status, the recent approval of the Omnibus Appropriations Act means a significant increase in filing fees.  For more information on the upcoming H-1B season process, please visit our latest memo.
