Breaking News: Supreme Court Issues Ruling on Birthright Citizenship Case

One of the first actions taken by the Trump Administration after inauguration in January 2025 was to issue an executive order ending birthright citizenship. That order had been paused by a federal judge until a more recent ruling by the U.S. Supreme Court on June 27, 2025 limited the ability of federal courts to issue nationwide injunctions on executive orders and broad national policies. The Supreme Court decision allows the Trump Administration to move forward with its executive order on birthright citizenship which will now take effect 30 days after the ruling, absent any further action.

With these latest developments, people born in the United States on or after July 28, 2025, will not be automatically entitled to U.S. citizenship if their parents are in the country illegally or if their presence is lawful but temporary (such as, but not limited to, those visiting the U.S. on a student, work, or tourist visa). This has enormous downstream impacts for hospitals, social security offices, state governments, and individuals who are expecting children in the United States.
