Cap Exempt H-1B Roundup – Key Strategies for Avoiding $100k and Other Updates

The Proclamation, signed on September 19, 2025, continues to have a significant impact on Cap-exempt institutions when hiring key foreign-born employees. University, public, and private school budgets generally cannot support the $100k per-use H-1B filing fee, which in many cases has halted the hiring of essential talent. In light of this unprecedented change, it is crucial that all schools have a clear plan.

David Zaritzky Brown, Managing Partner of Brown Immigration Law, drew on his 28 years of business immigration law experience to outline strategies for avoiding the fee, including building a pipeline of alternative visa options and implementing hiring approaches that bypass the $100k payment. While the Proclamation itself complicates matters, David also provided updates on the status of litigation and the likelihood of its success.

This free, SHRM-certified learning program was designed to help universities, schools, and other Cap-exempt employers chart a path forward despite the current and likely temporary $100k fee. Even if a federal court were to enjoin the fee before the program aired, David still guided participants on next steps, noting that early litigation might offer limited relief from the immediate impacts.

As with all webinars, David reserved extra time at the end of the session to answer questions. Given the sensitivity of this topic, attendees were able to participate in an extended Q&A to address their specific concerns.
