USCIS Finalizes FY 2024 H-1B Lottery

Over the weekend, USCIS’s registration platform was populated with new H-1B Cap Selection confirmation notices. On Monday, new selection announcements stopped appearing. At the end of the day, USCIS issued a release confirming “(W)e now have randomly selected, from the remaining FY 2024 registrations properly submitted, a sufficient number of registrations projected as needed to reach the cap, and have notified all prospective petitioners with selected registrations from this round of selection that they are eligible to file an H-1B cap-subject petition for the beneficiary named in the applicable selected registration.”

Thus, this Cap season has concluded. We are still in the process of notifying clients of a few remaining selections and notifying individuals and employers of non-selections. As we were unsure of the possibility of a 2nd selection against the Cap, those individuals who remain unselected should continue along the path we’ve discussed to maintain status.

We will keep this year’s non-selected group in our records so we can confirm registration again in 2024. For those who were selected, provided they still remain with the employer of record, we will move forward with filing an H-1B against this year’s cap.
